Medical Leave Extended to Same Sex Couples in All States

The Department of Labor has revised its definition of “spouse” in the Family Medical Leave Act (“FMLA”) to include legally married same sex couples in all states. Before this final rule by the Department, only same sex couples married and living in a state that recognizes same sex marriages could utilize the benefits under the FMLA.
